Terms and conditions of use

General information

Swiss Life Select Schweiz AG (hereinafter referred to as “Swiss Life Select”) operates and provides functionalities and services in the form of an individual mobile application (hereinafter referred to as the “app”) under the name mySwissLifeSelect CH. It may only be used for private purposes by private individuals (hereinafter referred to as “users”) who have successfully completed the registrationprocess for the app.

The app can be downloaded free of charge from the Apple App Store or the Google Play Store:

the use of the app is governed by these Terms and Conditions of Use. By accessing the app, Users declares their agreement with these Terms and Conditions of Use and recognise them as binding. Users further acknowledge that all information and data provided or processed via the mySwissLifeSelect app can also be viewed by Swiss Life Select Schweiz AG, even if the customer has a contractual relationship with another Swiss Life Group company.

In the interests of readability, no simultaneous use is made of the language forms masculine, feminine and other (m/f/o). The designation of persons applies equally to all genders.

Security standards and risks

The security of the app is continually reviewed and updated in order to ensure adequate protection of user data against unauthorised access or loss.

Although Swiss Life Select takes the security and uninterrupted operation of the app very seriously and implements the security measures described above, the security, uninterrupted availability, timeliness and confidentiality of the data displayed and/or transferred via the app cannot be guaranteed due to the open nature of the internet. Use of the app and the internet is therefore at users’ own risk (as is the storage of data and documents on the users’ work stations). Users are advised to take some extra precautions to increase security (firewall, virus protection, security patches etc.) and to activate the security settings on the hardware and software they use as recommended by the manufacturer.

Scope of right of use

The app is intended for simple, non-exclusive and non-transferable proper use. This comprises, but is not limited to, calling up, transmitting, downloading, saving and reproducing data and information and using programs and program parts, within the user's own system as allowed by these Terms and Conditions of Use and within the scope of the technical limitations of the app. Any other use of the of the app is prohibited.

The mobile app provided to users remains the sole property of Swiss Life Select. Any further rights such as commercial rights, copyright and all rights of use not explicitly transferred to the user also remain with Swiss Life Select and/or the owners of the property rights to the software.

Commercial use of access to the app or the services offered as part of the app, in particular their resale, is prohibited.

Paperless delivery of documents

Users can configure the app so that future communications and documents relating to business transactions with Swiss Life Select are sent electronically. In this case, users are notified when new documents are available via an e-mail sent to the address saved in the app for electronic document dispatch. Messages/documents shall be deemed to have been delivered as soon as they are available for download in the app.

Swiss Life Select also remains entitled to send documents to users additionally by post or only by post.

Maintenance and support

Maintenance work and updates for the app are carried out during off-peak hours as far as possible. The availability of the app cannot be guaranteed or can only be guaranteed to a limited extent during maintenance and update work.

Users’ duties and obligations

In order to use the app, users must have the usual standard of hardware and software required to connect to the internet (internet-compatible configuration) (“equipment”).

Users shall use the app and/or its associated (IT) services and functionalities only as intended, i.e. in particular only in accordance with these Terms and Conditions of Use, and they shall not misuse them. Users shall in particular not cause any disruption to the app when using the app, shall not transmit any advertisements, harassing messages (spam), viruses or other malware or illegal or unethical content, and shall not infringe any third-party rights (e.g. copyrights and trademarks) or otherwise breach legal provisions.

Swiss Life Select reserves the right to block individual access to the app, in particular if users use the app in an unlawful or contractually prohibited manner, or if blocking access is required to protect users’ data.

Login identification and authentication

To use the app, users must register and verify their identity.

User accounts will not be activated until the identity and address details of users have been validated using the information provided by the users (including biometric data).

Following initial registration, the app is accessed by entering the user name and password (access data). Users must change the password sent to them immediately upon receiving it and subsequently change their password from time to time. Access data may not be sent or made available to third parties. Should users discover that their access data has been obtained by a third party without authorisation or are being used by such a third party, they must notify Swiss Life Select of this immediately by using the form on the following website (DE, FR, IT only):

Any actions taken or access to the app using the access data constitutes an action or access by users, in particular also any requested completion of transactions. Swiss Life Select is not obliged to carry out further checks on users’ authentication and assumes no liability for losses resulting from any unlawful use or use exceeding the allocated authorisation of the access data or the app.

Data processing

The Group companies of the Swiss Life Group process the following data in particular in connection with the app:

  • the data provided by users, including the e-mail address and mobile phone number provided;
  • data from the use of the app, including access data, details of accesses, transactions and changes, search terms used and details of the operating system, browser and screen settings.

This data is communicated by users, collected through cookies and other technologies when using the app, or obtained by third parties. The Group companies of the Swiss Life Group may use this data for the following purposes, subject to mandatory provisions of applicable law:

  • processing of requests and contract management;
  • improving the user experience and optimising the services;
  • marketing purposes including content and offers tailored to the user, both within and outside the app, e.g. on third-party websites and in social media and through messages, e.g. by e-mail, push notification or letter;
  • to deliver messages, information and notifications via e-mail or social media or other electronic communication channels. 

Data may be aggregated with data held by third parties and re-used and shared in an anonymised form.

Data protection

Disclaimer of warranty

Swiss Life Select has no obligation to make the app available on a permanent or uninterrupted basis, and provides no guarantee that the app will be available or free of interruptions.

Equally, Swiss Life Select provides no guarantee as to the accuracy, completeness and timeliness of the data, information or documents offered, processed, made accessible or transferred via the app by Swiss Life Select, its partners, users or third parties. Any information, performance data and images provided in the app are for information purposes only. This data cannot be used as the basis for any rights. The information, performance data and images provided were produced with customary due diligence.

Only the Swiss Life Select administration and partner systems or information and documents provided via the internet or in another form and the data and information about users in the app can be used for any simulations, enquiries, calculations or requested completion of transactions in the app. No claims shall arise in respect of Swiss Life Select, companies in the Swiss Life Group or partners and providers of Swiss Life Select in the event of manipulations of the system or of the software provided by Swiss Life Select or of the security settings, data and information or in the event of the provision of incorrect data or the forging of data by the user or third parties.

Disclaimer

With regard to the app, Swiss Life Select shall exclusively be liable for losses caused intentionally or through gross negligence. Any further liability is excluded to the extent permitted by law.

Adjustments and termination of use

Swiss Life Select may restrict or adjust the functions of the app at any time. There is no entitlement to the permanent or unchanged availability of the app. Use of the app can also be terminated at any time by users or by Swiss Life Select, with or without good cause. In the event of termination of use, any paperless option selected in the app (see above) will expire.

Cookies

The app can send cookies to users’ computers, which are then stored there. A cookie is a string of data that is used to automatically collect data about the use of a website. This data also includes the IP address (internet protocol address) of users, similar, in terms of its function, to users’ telephone numbers. Data received via cookies are primarily used for website administration purposes, quality assurance, the collection of demographic data and to monitor the use and performance of the app. If the cookie function on users’ workstations is deactivated or corresponding filters are used, it may be that not all information and data about the app can be correctly accessed or received. Swiss Life Select accepts no liability for any losses incurred due to such restricted use.

Further provisions

Swiss Life Select may amend the Terms and Conditions of Use at any time. Any amendments are shown in the app. They shall be deemed to have been accepted if users continue to use the app.

In addition to these Terms and Conditions of Use, the Legal Notices and Terms and Conditions of Use published on the websites of Swiss Life Select (https://www.swisslife-select.ch, DE, FR, IT only) shall apply.

Swiss law applies. The exclusive place of jurisdiction is Zug.
